A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without legal authority.

"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her ruling.

The situation stems from a mistaken removal to El Salvador in March, which the government later admitted was an error. After his return to the United States to answer human smuggling charges, he was held in federal detention.

In her order, the judge pointed out that the authorities lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
